Was it doen with permission and if not is that legal? The only reason I ask is that there is someone I used to know who would have me up in front of a judge if I did something like that.

Showing tits doesn't constitute porn, otherwise there wouldn't be a page 3 in that silly rag people buy.
If the artist claims it is the person you say it is (No link) and permission wasn't granted by that person, they certainly have reason to take action.
