
BBC Radio presenter held over 'Court order breach'
The BBC radio presenter Andy Kershaw has been held in custody on the Isle of Man where he lives for breaching a current restraining order.
48 year old Kershaw who presents on Radio 3 was arrested on August 29th near the home of his former partner, Juliette Banner.
Ms Banner had previously obtained a restraining order preventing him from visiting her in Peel, Isle of Man.

I have no idea of the history here but what I can say is that I'm glad she managed to get a restraining order (no mean feat in the British Courts - presumably the Isle of Mann courts run on similar lines?) if he was hassling her.
Also nice to see that his 'fame' doesn't prevent the law enforcement people from taking proper and appropriate action.
I do, however, feel sorry for her. I imagine she'd prefer this not to be plastered all over the news.
A few years back I had to get a restraining order against a patient. The patient went to the local newspapers about it and it was awful, I didn't want that to happen. (The patient ended up breaking the restraining order and I won't go into the details but he finished up in prison over it which is why I feel ok to talk about it openly now since it's been reported!)
But, I can tell you this, it was not easy to get the restraining order. I had to produce SO much evidence it was unreal. It made ME feel like the guilty party to be honest with you.
So, I applaud her for managing to get one. I honestly don't know what he might have done (or not done) but I don't believe the courts grant these orders for no reason. I hope she remains safe and that this doesn't set her back.
When my order was breached it made me feel really terrible and made me completely paranoid about security which is something I still feel to some extent to this day.
So I really hope she is ok through all of this, don't forget about her in all of this.

Actually, it is not that difficult to get a restraining order, in Scotland at least. If you have committed more than one act that causes worry, fear or distress then a restraining order is almost a given. And the rule here is that it does not matter whethyer any such worry, fear or distress was intended, if the recipient experiences that and feels that any further contact would heighten those feelings, then a court is unlikely to turn down such a request.
I don't know wbout England or the Isle of Man, but that is how it works up here.
EDIT: Having read your case, twinky, it can get messy if the person you are trying to get the order against wants to cause problems - looks like you came up against a bad one there.![]()

I saw on the news yesterday that he'd pled (?pleaded) guilty to the breach.

I'm not sure what to say to that Alpha. I heard somewhere that he was drunk and so perhaps wasn't as aware as he should've been about what he was doing.
I'm just not sure saying 'sorry' is good enough. But, hey, that's just me. I don't know what else he could do apart from say sorry though.
